
BOOKING INFORMATION, TERMS and CONDITIONS
•
Dolphins and other wild life: Wild and Free only visit genuinely
wild and free animals and cannot guarantee their presence. On dolphin-swim
programmes we do expect dolphins to be present at least 80% of the time
based on past history.
• Swimming: On dolphin-swim programmes, you must
be able to swim and be confident in open water.
• Risks: Swimming with dolphins is a moderately physically
strenuous active holiday and can be in remote areas or where there can be
additional risks of disease and injury. It is not suitable for people with
certain health and fitness conditions. Please get medical advice before
booking if you are pregnant, over 60 years of age, have endured an injury
or operation or have any doubts about your ability. Our boat operators have
very structured procedures and regulations to ensure maximum safety in the
boats and in the water. It is wholly within your responsibility to indicate
upon booking, the degree of competence and experience you have in the open
water. It is also imperative that you inform us of any health condition
whatsoever (physical or emotional) which could effect your participation
in the open water activities.
• Itinerary: The holiday itinerary should be used
only as a guide. We reserve the right to change it to take into account
unexpected conditions, and of course to take account of the dolphins or
weather conditions.
• The decisions of the Tour Leader or Camp Manager
are final on all matters relating to the programme.
• Excursions: Any excursions or on-site activities
which may be arranged on behalf of clients after the commencement of the
holiday are not to be treated as forming part of the clients' holiday package.
• We accept responsibility for ensuring that all
component parts of your holiday are supplied to you as confirmed by us to
you in travel details and that the services offered are a reasonable standard.
If there is anything which you consider needs repairing or changing, or
is not to your satisfaction, please notify us immediately and we will respond
to remedy the situation within 24 hours.
• Transport: We will arrange airport and boat transfers.
We use local providers who we have always found to be safe and efficient.
If you have any cause for concern about the driving or the vehicle condition,
please stop the driver and contact us on the mobile phone numbers provided
in your holiday information provided by us.
• Conduct: Wild and Free reserves the right to require
to withdraw from the holiday any person whose actions or conduct is considered
by Wild and Free in its absolute discretion to be incompatible with the
comfort and safety of other clients or to be offensive to them, or breaks
the laws or local regulations of the country. In the event of such conduct,
no liability whatsoever will be owed to that person by Wild and Free upon
withdrawal from the holiday.
• Travel Documents: It is your responsibility to
ensure that all necessary travel documents such as passports, visas and
flight tickets are obtained and valid.
• Travel Insurance: It is an essential condition
of your booking a holiday that you take out comprehensive holiday insurance.
We will ask you to let us have evidence of the insurance prior to the commencement
of the holiday and your holiday is subject to adequate insurance cover being
in place before then.
• Flights: Wild and Free recommends ABTA and ATOL
registered travel agencies for your travel arrangements.
• Brochures: To keep our prices low and to conserve
trees, as well as to give us the flexibility to present you with the most
up to date information at all times, we do not produce a brochure. All the
information is posted on our website, which is regularly updated.
• Under 18 clients must be accompanied by a responsible
adult.
• Payment: We welcome payment in sterling by credit
card, cheque, bank transfer or bank draft. Cheques should be crossed and
made payable to 'Wild and Free In Trust for Clients Account' and sent to
the address below.
• Deposit: An initial non-refundable deposit of £200
per person is required together with a signed booking form (signed by the
named client or a parent or legal guardian if under 18) must be received
by Wild and Free before any contract exists. If booking less than 90 days
prior to departure the full amount is payable. Any balance is due 90 days
prior to departure. If the balance is not paid in time we reserve the right
to cancel your holiday and apply the cancellation charges as set out below.
All bookings will be confirmed by Wild and Free by email.
• Your Security: Wild and Free operates a Trust Account,
meeting the UK and EC regulations regarding travel and package holidays,
providing 100% financial security to consumers. This means that your money
will be refunded in the unlikely event of our withdrawing our services or
insolvency.
• Complaints: If you have any complaint you should
make it known at the earliest opportunity to our local representative. If
they are unable to resolve the problem to your satisfaction you should contact
our UK office. If at the end of your trip you feel that your complaint has
not been properly dealt with you must first notify us in writing within
21 days of your scheduled date of return and we will do our best to resolve
the problem.
• Holiday cost breakdown: The details of individual
costs which make up the total quotations for client bookings are confidential
between ourselves and our suppliers. We therefore cannot provide breakdowns
of individual costs.
• No refunds will be given for any part of the programme
provided but not participated in by the client.
• Your booking is accepted on the understanding that
you realise that the tourism infrastructure in relation to both travel and
accommodation may be substantially lower than you would expect in Europe
or North America. As a consequence we do our best to make sure internal
connections and transfers go smoothly but this may not always be possible
due to flight cancellation, local political situations, weather, mechanical
breakdown, or other unforeseen circumstances. No refunds will be given for
services not utilised.
• Cancellations must be in writing and will incur
the following charges: Up to 90 days before departure = loss of deposit.
90 or less days before departure = loss of 100% of total price.
• Alterations by you: We will do our best to make
any alterations you may require after confirmation has been issued subject
to the payment of any increased costs relevant to the change, and if less
than 12 weeks prior to departure in addition a £30 charge will be
levied together with any communications costs incurred.
• Delays: As the travel arrangements that we arrange
are for small numbers of passengers we can make no special arrangements
if you are delayed at the outward or homeward points of departure.
• Foreign Office Travel Advice: From time to time
the British Foreign Office (www.fco.gov.uk)
issues Travel Advisory Notices giving advice regarding travel to a particular
destination, which you should consult. If the FCO advises against all travel
we will probably have to cancel your holiday (we have to follow the advice
of our insurers). If the FCO advises against non-essential travel we will
not usually cancel your holiday, but will be happy to give our opinion of
the possible risks involved. The decision to travel or not in this case
will be yours, and our normal cancellation conditions will apply. You should
also check your travel insurance to confirm how an FCO Travel Notice affects
your policy, as this varies between insurers.
• Liability: We do not accept any liability for:
cancellations; delays or changes caused by war, threat of war, closure of
airports, civil strife, industrial action, natural disaster, technical problems
due to transport, staff cancellations or other events beyond our control;
participants' medical or psychiatric conditions which may develop during
or subsequent to the holiday or programme; loss of or damage to personal
property of participants; or any expenses incurred whilst travelling to
or from or in preparation for the programme.
• Cancellation by us: We reserve the right to cancel
individual bookings or terminate any arrangement at our discretion. Subject
to circumstances not involving any breach of our booking conditions all
moneys paid to Wild and Free will be refunded.
• Drugs: Do not have anything to do with recreational
drugs and do not bring them with you.

Jurisdiction: All matters arising from
your contract with us are governed by English Law and are subject to the
exclusive jurisdiction of the English Courts.
